By accessing and using scaleworks.ai or any Scaleworks service operated by Decebal LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Scaleworks is the growth engine of Decebal LLC. Services include but are not limited to:

• Outbound sales development and appointment setting
• Paid demand generation and campaign management
• Content and demand generation programs
• Revenue intelligence, reporting, and accountability through xLive
• CRM implementation and workflow automation on GAMA
• Lead qualification, nurturing, and booking systems
• Custom growth systems tailored to your business processes

As a user of our services, you agree to:

• Provide accurate and complete information when using our services
• Maintain the confidentiality of your account credentials
• Use our services only for lawful purposes
• Not interfere with or disrupt the integrity of our services

All content, features, and functionality of our services are owned by Decebal LLC and are protected by international copyright, trademark, and other intellectual property laws.

Decebal LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services.

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by updating the "Last updated" date at the top of this page.

You can cancel the SMS service at any time. Just text "STOP" to the designated phone number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at legal@decebal.ai.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles.

Any dispute shall be brought in the state or federal courts located in Stark County, Ohio.

Any dispute, controversy, or claim arising out of or relating to these Terms of Service, or the breach, termination, or validity thereof, shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Stark County, Ohio.

The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Each party shall bear its own costs and expenses, including attorney's fees, unless the arbitrator determines otherwise.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Decebal LLC.

Decebal LLC operates an SMS notification and communication program for opted-in customers and prospects. The program is described below.

Program name: Decebal Customer Communications.

Message categories: (1) appointment confirmations and reminders, (2) no-show follow-ups, (3) invoice and payment reminders to active clients, (4) two-way conversational replies to sales inquiries received by SMS.

Message frequency: variable, estimated at 4 to 20 messages per month per opted-in contact.

Opt-in method: consent is collected on scaleworks.ai through the contact form at /contact and through the appointment booking form. Each requires an unchecked-by-default consent checkbox at the time of form submission. Consent is not a condition of purchase.

Message and data rates from the recipient's carrier may apply. Reply STOP to any message to opt out at any time. Reply HELP for support. Support is also available at info@decebal.ai or +1-941-299-9290.

Neither Decebal LLC nor its mobile providers are liable for delayed or undelivered messages. Delivery of SMS messages is subject to carrier and network availability.

Users must be at least eighteen (18) years of age to access scaleworks.ai, submit any form on the site, opt in to SMS communications, or otherwise engage with the services described in these Terms.

By submitting any form, opting in to SMS, or otherwise using the services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

Decebal LLC does not knowingly collect personal information or SMS opt-in consent from individuals under the age of 18. If Decebal LLC learns that information has been collected from a minor, Decebal LLC will delete that information promptly.
